EUROPEAN UNION TEMPORARY LEAVE TO REMAIN: EXPLAINED

 

The Home Office has issued official regulation on the European Union Temporary Leave to Remain scheme, what the official guidance has named “a responsible government”,





The motive for the citation to the government’s accountability is that the European Union Temporary Leave to Remain scheme is an emergency plan in case the United Kingdom exits the European Union with no withdrawal agreement means a no deal Brexit. The European Union Temporary Leave to Remain status is intended for European Economic Area residents who may desire to arrive into the United Kingdom after 29 March 2019 in a no deal Brexit situation. (European Economic Area nationals are the citizens of the 28 countries at present making up the European Union (comprising, at present, the United Kingdom) along with Iceland, Liechtenstein and Norway). This temporary leave condition will also stretch out to Swiss citizens.

 

The present rules make it distinct that for a transitional period (if there is a no deal Brexit) European Economic Area nationals will be able to arrive in to the United Kingdom in the similar route as they do currently. Furthermore, no authorization or immigration status will be necessary for any European Economic Area nationals desiring to live in the United Kingdom for less than 90 days. The main modification, nevertheless, is that when free movement finishes and before the government’s planned latest immigration system begins functioning in 2021, European Economic Area nationals desiring to reside in the United Kingdom for more than 90 days (whether to get a job, study, holiday or join family members) will have to apply to be permitted this new European Union Temporary Leave to Remain.




European Economic Area nationals who effectively obtain this new status will be able to reside in the United Kingdom for three years from the date of application. The Home Office have emphasized that this status will be short-term and cannot be prolonged. Furthermore, it will not direct to any privilege to ILR (or any facility to live forever in the United Kingdom) nor will it direct to the ability to acquire any status under the European Union Settlement Scheme.

 

Having ensured European Union Temporary Leave to Remain, any European Economic Area national desiring to live in the United Kingdom further than the three year time will have to apply positively for a new status under the brand new skills-based immigration system the government plots to initiate from 1 January 2021.
