In the October 2020 Statement of Changes HC 813 it was announced that a new visa under the terms for visitors has been founded. The new S2 Healthcare Visitor visa is for EEA citizens who before the termination of the Brexit transition period have ensured permission from their member State to attain medical treatment in the UK offered by the National Health Service (NHS). From 1 December 2020 at 9:00am applications under the S2 Healthcare Visitor route will be available.

The latest and updated Statement of Changes presented the new S2 Healthcare Visitor Visa route as the following:

This visa route associates to the UK’s departure from the European Union. It is for an individual who, before the termination of the transition period (11pm on 31 December 2020), had applied for an authorisation to get a course of planned healthcare treatment under the S2 route, pursuant to Regulation (EC) No 883/2004.
With the aim of being eligible for the S2 Healthcare Visitor, one of the following conditions should be applicable to the Applicant for the afore-mentioned visa:
- Article 26a(1)(b) of the Swiss citizens’ rights agreement; or
- Article 31(1)(b) of the EEA EFTA separation agreement; or
- Article 32(1)(b) of the withdrawal agreement.

Applicants must attain entry clearance under this visa route before arriving in the UK excluding if they are a non-visa national, in this case they can apply at the border.

Successful Applicants of S2 Healthcare Visitor will be allowed permission to come or reside in the UK for up to 6 months in order to complete their medical treatment. Patients will be heavily relying to the visa obligations of no recourse to public funds, they will not be permitted to work or study in the UK and they may have to register with the local police (where applicable). The good news isthat unsuccessful S2 Healthcare Visitor Applicants can have the decision evaluated by way of Administrative Review as well.
